Please read these Terms of Use and Disclaimer ("Terms") carefully. The App is operated solely by BigSystems LLC ("BigSystems," "we," "us," or the "operator"), not by any member or manager in an individual capacity. By downloading, accessing, or using Where to Poop (the "App"), you agree to these Terms. If you do not agree, do not use the App.

1. Relationship to Apple's Standard EULA

These Terms supplement the Apple Licensed Application End User License Agreement (the "Apple Standard EULA") that applies to the App through the App Store. They do not replace it. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls to the extent required.

2. What the App Is

The App is an informational tool that helps people locate public or semi-public restrooms and view community-contributed details such as cleanliness ratings, amenities, and availability. Location and place data are sourced from Apple Maps and from other users. The App does not own, operate, inspect, or control any restroom or venue it lists.

3. No Warranty; Information May Be Wrong

The App and all content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

Listings, locations, ratings, amenities, hours, and availability may be inaccurate, incomplete, outdated, or wrong. Restroom access is not guaranteed — a location may be private, closed, restricted, require a purchase, or not exist. Always verify independently before relying on any information in the App. You use the App and any information in it at your own risk.

4. Assumption of Risk and Personal Safety

You are solely responsible for your own decisions, conduct, and safety when traveling to or entering any location. The App is not an emergency, safety, inspection, or navigation service. Follow all laws, posted rules, and the instructions of property owners, do not trespass, and use your own judgment about whether a location is safe and appropriate to enter.

5. Limitation of Liability

To the fullest extent permitted by applicable law, BigSystems LLC and its members, managers, officers, employees, agents, affiliates, suppliers, licensors, service providers, and contributors (the "Protected Parties") will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, personal injury, property damage, or other losses, arising out of or relating to your use of (or inability to use) the App or any information in it, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages.

To the extent liability cannot be fully excluded, the total aggregate liability of all Protected Parties for all claims arising out of or relating to the App will not exceed the greater of the amount you paid to use the App during the twelve months before the event giving rise to the claim or fifty U.S. dollars (US$50.00). This is an aggregate limit for all claims, not a payment, fee, penalty, or per-incident amount. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply; in that case, liability is limited to the maximum extent permitted by law.

6. User-Generated Content

Ratings, comments, listings, and reports are submitted by users and reflect those users' own opinions and information, not those of the operator. The operator does not endorse and is not responsible for user-generated content.

You represent that your submissions are truthful, made in good faith, based on a genuine experience where applicable, and do not violate any law or another person's intellectual-property, privacy, publicity, or other rights. You agree not to submit content that is unlawful, harassing, hateful, threatening, defamatory, sexually explicit, invasive of privacy (including private addresses or personal information), misleading, automated, promotional, spam, or otherwise objectionable.

You retain ownership of original content you submit. You grant BigSystems LLC a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, format, redact personal information from, and otherwise use that content solely to operate, secure, moderate, improve, and promote the App and its community information. This license continues for copies reasonably retained in backups, security records, and moderation records after public removal.

We are not obligated to review every submission before publication. We may hide or remove content, redact personal information, reduce trust status, restrict contribution access, and preserve moderation records. Users can report content and block contributors. A contributor must be at least 13 years old or use the App under the supervision of a parent or legal guardian.

7. No Affiliation; Trademarks

Business, brand, and venue names shown in the App are used for identification only. The App is not affiliated with, endorsed, sponsored by, or associated with any such business, and all trademarks and brand names are the property of their respective owners. Inclusion of a venue does not imply that its owner permits public restroom use.

8. Third-Party Data and Services

Place and map data are provided by Apple Maps / MapKit, and community data is stored using third-party infrastructure. Those services are governed by their own terms, and the operator is not responsible for third-party data, availability, or accuracy.

9. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Protected Parties from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from content you submit, your unlawful or intentionally harmful conduct, or your material violation of these Terms or another person's rights. This section does not require a consumer to indemnify a Protected Party for that Protected Party's own unlawful conduct and does not apply where prohibited by law.

10. Suspension and Termination

We may suspend or terminate contribution or administrative access, remove content, or discontinue all or part of the App when reasonably necessary for security, legal compliance, moderation, maintenance, or protection of users and the service. Sections that by their nature should survive termination, including content licenses, disclaimers, liability limits, indemnification, and dispute provisions, will survive.

11. Changes

We may update these Terms as the App changes. Material changes will be identified by a new "Last updated" date and, when required, additional notice. Changes apply prospectively from their effective date unless applicable law permits otherwise.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Nebraska and applicable federal law, without regard to conflict-of-laws rules. To the extent a dispute may lawfully be subject to an exclusive forum, it must be brought in a state or federal court of competent jurisdiction located in Nebraska. Nothing in these Terms deprives a consumer of protections or forums that cannot legally be waived.

13. General Terms

If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; BigSystems LLC may assign them in connection with a merger, reorganization, sale, or transfer of the App. These Terms, the Privacy Policy, the Community Guidelines, and the Apple Standard EULA form the applicable agreement concerning use of the App.
